Open Records Requests

The Boards of Directors of the Eagle River Water & Sanitation District ("ERWSD") and Upper Eagle Regional Water Authority ("UERWA") support and comply with all Federal and State laws relating to the retention, protection, and disclosure of District and Authority records including, but not limited to, the Colorado Open Records Act, Title 24, Article 72, Part 2, C.R.S. (“CORA”), the Health Insurance Portability and Accountability Act of 1996 (“HIPAA”), and the Privacy Rule promulgated by the U.S. Department of Health and Human Services which interprets and implements HIPAA.

The ERWSD Open Records Policy and UERWA Open Records Policy were adopted by board resolutions on January 25, 2024. Under these policies, public records are open for inspection by any person at reasonable times, except as otherwise provided by law. Public records are defined by CORA as all writings made or maintained by the District or Authority, regardless of the format or medium of the records, subject to certain exceptions. As permitted under Colorado State Law, ERWSD and UERWA charge a fee for CORA requests.

Open records requests must be submitted in writing to the Official Custodian of Records. Requests may be submitted by sending an email to [email protected]

  • Requests should be as detailed as possible including date, type of record, etc.
  • If the document name is unknown, provide a brief but specific description of the document or information requested (note date of issuance and location of the document, if known).
  • A request which is broad, vague, or too voluminous may cause a delay in the time it takes to produce the records.
