APPENDIX A
EAGLE RIVER WATER & SANITATION DISTRICT
SCHEDULE OF FEES AND CHARGES
EFFECTIVE: January 1, 2010
Eagle River Water & Sanitation District regulates sewer from Vail and west through Cordillera (including the Town of Minturn). The District also regulates water in the Town of Vail. Upper Eagle Regional Water Authority regulates water in Avon/Eagle Vail through Cordillera (see Appendices A7 through A9). Water meters and fire hydrant meter rules and regulations are noted in Appendices A1 through A6.
WATER FEES AND CHARGES (VAIL):
1. Residential Water Tap Fee Calculation
$3.73 per square foot of living space area. Floor area is calculated on the gross square foot measurement to include the outside walls, unfinished areas, mechanical rooms, and basements over five (5) feet high, excluding garages, attics and, in a multi-unit or mixed use facility, circulation space.
2. Expansion or Remodel to Existing Residential Units
The term “existing residential units” shall refer to those residential units in existence prior to January 1, 1987. Each existing residential unit within the District less than 3,000 gross square feet may increase the size of the unit to 3,000 square feet without additional tap fee assessment. Any additions over 3,000 square feet will be assessed a tap fee for the additional square feet.
Residential units built after January 1, 1987, will be assessed an additional tap fee for any increase in square footage.
3. Commercial Water Tap Fee Calculation
Commercial uses may be on a separate master meter or, for mixed uses, may be on the same meter as Residential/Hotel units, if the customer provides the District with an Engineer’s or Architect’s assessment of the meter size necessary to serve the commercial and irrigation fixtures involved. The meter size is to be determined by the fixture count assessment according to the International Plumbing Code.

The District requires that each commercial meter two inches (2”) or larger have a bypass installed.
4. Treated Water Storage Fee Calculation
A Treated Water Storage fee shall be assessed upon which a new development or re-development is proposed, and which requires an increase in water use or new water use not allowed by existing taps or zoning to provide treated water storage adequate to meet the needs of the proposed development. For proposed developments the District determines cannot be served by an existing treated water storage facility, the property owner shall provide a water storage tank or tanks and the land therefore or the owner of the proposed development may pay cash in lieu of new treated water storage at a fee of $1,225 per SFE.
5. Sprinkler/Irrigation Tap Fee
Sprinkler Water Accounts (associated with a structure but on a separate meter): For seasonal sprinkler taps, the District will allow a tap without a tap fee.
Irrigation Water Accounts (not associated with a structure): For seasonal irrigation taps, the District will allow a tap without a tap fee.
6. Water Meters
Meter sizes for all applications shall be determined by the District. The appropriate water meter shall be purchased from the District for new structures. Once installation of the meter has occurred, the District shall inspect the installation for compliance with District rules prior to water turn on.
7. Meter Repair
Refer to Appendix B – Water and Sewer Service Construction Specifications, Water Services, Water Meter and Remotes.
8. Water Service Charges
Water service charges are billed monthly, in arrears.
a. Metered Water Accounts:
Monthly Water Base Rates per Single Family Equivalent (SFE)
$13.62 Base Service Rate, plus
$2.62 Vail-Water Debt Service Base Rate

Residential Unit:
A Residential Unit up to 3,000 square feet with a cooking facility is equal to 1.0 Single Family Equivalent (SFE). Accounts with a SFE determined to be above 1.0 SFE (square footage of structure greater than 3,000 square feet) must multiply all base rates and usage allowances per tier by the account’s assigned SFE. This allows for each account to pay proportionate monthly base rates and allows for more water use in each tier. -
Efficiency Unit:
An Efficiency Unit is a single room with a bathroom and a cooking facility and is equal to 0.50 SFE. -
Accommodation Unit:
An Accommodation Unit is a room with or without a bathroom, but without a cooking facility with private access to a central corridor or the outside and is equal to 0.35 SFE.
b. Usage Rate:
For metered consumption, the usage rate is $2.06 per 1,000 gallons up to 10,000 gallons, $3.93 per 1,000 gallons for 11,000 to 40,000 gallons, and $6.16 per 1,000 gallons for 41,000 gallons and over of water per month, per SFE.
c. For Lawn Sprinkler Water Accounts (associated with a structure but on a separate meter):
For lawn sprinkler accounts the usage rates area as follows:
$2.06 per 1,000 gallons up to 7,000 gallons, and $3.93 per 1,000 gallons from 8,000 gallons to 40,000 gallons, and $6.16 per 1,000 gallons for 41,000 gallons and over. Usage allowance per tiers move based upon the account specific Sprinkler Irrigation Ratios (SIR), which is linked to the total SFE count of the associated structures the lawn sprinkler services.
d. For Irrigation Water Accounts (not associated with a structure):
If the square footage or acreage to be irrigated cannot be defined, the account’s usage rates are as follows:
$4.67 per 1,000 gallons up to10,000 gallons, $7.13 per 1,000 gallons from 11,000 to 40,000 gallons, and $10.31 per 1,000 gallons for 41,000 gallons and over. Usage allowance per tiers move based upon the account specific SIR, which is associated with the SFE equivalent based upon the meter size.

If the square footage or acreage to be irrigated can be defined, the account’s usage rates are as follows:
$4.67 per 1,000 gallons up to 175,000 gallons, $7.13 per 1,000 gallons from 176,000 gallons to 234,000 gallons, and $10.31 per 1,000 gallons for 235,000 gallons and over. Usage allowance per tiers move based upon the account specific Sprinkler Irrigation Coverage (SIC), which is based upon the acres being irrigated rounded to tenths.
Example: 3,500 square feet to be irrigated (1 acre = 43,560 square feet)
3,500 sq. ft./43,560 sq. ft. = .08
SIC = .08
SEWER FEES AND CHARGES:
9. Residential Sewer Tap Fee Calculation

The water meter size is to be determined by the fixture count assessment according to the International Plumbing Code.
All commercial and/or industrial wastewater users will be required to pre-treat their effluent if their discharge does not meet domestic standards and/or falls under the Federal Classification of Hazardous Waste.

a. For Sewer Accounts Associated with a Water Meter:
Sewer Minimum Rate per SFE is 5,000 Gallons:
- Residential Unit:
A Residential Unit up to 3,000 square feet with a cooking facility is equal to 1.0 SFE. Accounts with a SFE determined to be above 1.0 SFE (square footage of structure greater than 3,000 square feet) must multiply all base rates and usage allowances per tier by the accounts assigned SFE. This allows each account to pay proportionate monthly base rates and allows for more water use in each tier. - Efficiency Unit:
An Efficiency Unit is a single room with a bathroom and a cooking facility and is equal to 0.50 SFE. - Accommodation Unit:
An Accommodation Unit is a room with or without a bathroom, but without a cooking facility with private access to a central corridor or the outside and is equal to 0.35 SFE.
Note: Gallons are rounded to nearest thousand.
b. Usage Charge:
A usage charge of $4.87 per 1,000 gallons of water used from January to April (billing dates), with a minimum of 5,000 gallons per SFE per month. The average usage for January to April (billing dates) will be used to calculate the service charge for the remaining eight (8) months of the year. In addition, a $1.56 Sewer- Debt Service Base Rate per SFE will be assessed.
c. For Un-metered Sewer Accounts:
A flat rate monthly charge of $38.96 per SFE, plus a $1.56 Sewer-Debt Service Base Rate per SFE will be assessed.
d. For New Construction or Ownership Transfers from May - December:
New accounts and property transfers from owner to owner taking place outside of the sewer averaging period (May through December) will be subject to a “No Winter Average” service rate of $24.35 per SFE, plus a $1.56 Sewer-Debt Service Base Rate per SFE, until January of the following year.
13. Fire Hydrant Meters Policy
Fire hydrant meter use is allowed between April 15 and October 15, provided freezing at night is not occurring. The customer is responsible for any damage to fire hydrants or fire hydrant meters, which includes vandalism or freezing. A deposit of $2,500 is required for a three week (3) period, which is fully refundable, provided the meter is returned in good condition and there is no damage to the fire hydrant. A $136 installation and removal charge, payable in advance, is required (non-refundable). The rental rate shall be $130 per week, plus the water usage rate of $4.67 per 1,000 gallons up to 158,000 gallons, $7.13 per 1,000 gallons from 159,000 gallons to 632,000 gallons, and $10.31 per 1,000 gallons for 633,000 gallons and over of water per month based upon a Sprinkler/Irrigation Ratio of 15.8.
Fire hydrant water shall not be used for drinking purposes at any time. A relocate fee of $68 to move the fire hydrant meter from one fire hydrant to another is required.
Only District personnel are allowed to move fire hydrant meters. Contractors will be subject to a penalty if they attempt to move or alter a fire hydrant meter.
Short-term use of fire hydrant meters is allowed without a deposit. The cost to the customer is $68 per hour plus $4.67 per 1,000 gallons up to 158,000 gallons, $7.13 per 1,000 gallons from 159,000 gallons to 632,000 gallons, and $10.31 per 1,000 gallons for 633,000 gallons and over of water per month based upon a Sprinkler/Irrigation Ratio of 15.8.
APPENDIX A
UPPER EAGLE REGIONAL WATER AUTHORITY
SCHEDULE OF FEES AND CHARGES
EFFECTIVE: January 1, 2010
1. Participating Districts
Arrowhead Metropolitan District, Bachelor Gulch Metropolitan District, Beaver Creek Metropolitan District, Berry Creek Metropolitan District, Cordillera Metropolitan District, Eagle-Vail Metropolitan District, Edwards Metropolitan District, Traer Creek Metropolitan District, and the Town of Avon.
Please refer to Appendices A1 through A6 for Upper Eagle Regional Water Authority’s rules and regulations on water meters and fire hydrant meters administered by Eagle River Water & Sanitation District.
Incremental Plant Investment Fee:
An incremental fee to help fund capital projects and building of new Drinking Water Facilities.
Residential Use:
Floor area is calculated on the gross square foot measurement to include the outside walls, unfinished areas, mechanical rooms, and basements over five (5) feet high, excluding garages, attics and, in a multi-unit or mixed use facility, circulation space.
Customer shall provide a letter from the Architect or the Engineer certifying the size of the building using the District’s definition.
• $1.55 per square foot for 0 to 2,500 square feet (minimum $1,550)
• $1.91 per square foot for 2,501 to 3,500 square feet
• $2.33 per square foot for 3,501 to 5,000 square feet
• $2.99 per square foot for 5,001 square feet and up
Commercial Use:

ARROWHEAD METROPOLITAN DISTRICT
SCHEDULE OF FEES AND CHARGES

1. Residential Water Tap Fee
Residential Unit:
Arrowhead Metropolitan District (which includes the Donovan Parcel) Water Tap Fee is $5,500 per unit up to 600 square feet, plus $2.00 per square foot thereafter (Minimum $5,500). Mountain Project is $8,250 per unit up to 600 square feet, plus $3.00 per square foot thereafter, effective June 27, 2001 (Minimum $8,250). Floor area is calculated on the gross square foot measurement to include the outside walls, unfinished areas, mechanical rooms, and basements over five (5) feet high, excluding garages, attics and, in a multi-unit or mixed-use facility, circulation space. Customer may be required to obtain a letter from an Architect or Engineer certifying the size of the building using the District’s definition of square footage.
Efficiency Unit:
Arrowhead Metropolitan District Water Tap Fee is $2,750 per Efficiency Unit. The Mountain Project Water Tap Fee is $2,888 per Accommodation Unit. 5. Fire Hydrant Meters Policy

TOWN OF AVON

Residential Unit:
a) Base Tap Fee
Town of Avon Water Tap Fee is $4,000 per unit up to 3,000 square feet, plus $2.00 per square foot thereafter, plus $2.00 per square foot for a private swimming pool. Floor area is calculated on the gross square foot measurement to include the outside walls, unfinished areas, mechanical rooms, and basements over five (5) feet high, excluding garages, attics and, in a multi-unit or mixed use facility, circulation space. Customer may be required to obtain a letter from an Architect or Engineer certifying the size of the building using the District’s definition of square footage. (Minimum $4,000)
b) Oversized Unit Surcharge
A surcharge will be collected from all residential units in Avon, excluding those within Mountain Star subdivision, exceeding 3,000 square feet in size will be charged an additional $1.40 per square foot. A surcharge will be collected from residential units in Mountain Star exceeding 7,500 square feet in size will be charged an additional $1.40 per square foot. Where zoning designates a specific number of residential units for a lot, the property owner may apply those designated residential units towards the Oversized Unit Surcharge provided that the total development of the lot does not exceed the number of SFE’s designated for the lot.
Efficiency Unit:

The Town of Avon Engineer will then determine the adequacy of the existing water allocation and determine the appropriate surcharge for the new development or additions, up to $4,200 per SFE.

The Wastewater System Tap Fee is due in two components, an Engineering Fee and a Construction Fee as follows:
A Wastewater System Engineering Fee of $4,000 is due at the time of submittal of plans to the Design Review Board.
A Wastewater System Construction Fee of $25,000 for up to 4,000 square feet of floor area plus $2.00 per square foot over 4,000.Area is calculated on the gross square foot measurement to include the outside walls, unfinished areas and concrete basements, excluding garages, attics, and multi-unit common spaces. Property owners shall be required to obtain a letter from an Architect or Engineer certifying the size of the building using the District’s definition of square footage. Wastewater System Construction Fees are due in full at the issuance of the building permit.
5. Water Service Charges
Water service charges become effective the day of the payment of the tap fee and are billed monthly, in arrears. Additional square footage added could result in a recalculation of Single Family Equivalents (SFE) for service charge calculation. Single Family Equivalents (SFE) is a general Residential Unit, the use of which is estimated to have an impact upon the water and/or sewer systems equal to that of the average single family (2.3 persons) 1 SFE is up to 3,000 square feet. For metered accounts, the minimum monthly charge is $45 per month, per SFE Unit, and $5.50 per thousand (1,000) gallons of water. For accounts with broken meters or unmetered accounts, the rate charged shall be $77.25 per Single Family Equivalent unit per month.
6. Irrigation Use
Irrigation uses on a separate meter are not subject to District sewer tap fee or monthly sewer O & M base fee.
7. Sewer Service Fee
Sewer O&M fees for commercial (golf course) facilities become effective the day of the payment of the tap fee and are billed monthly at a rate of $31.25 per SFE.
Sewer O & M fee for a residence becomes effective the day of the payment of the tap fee and is billed at a fixed fee of $75.00 per month (per residence).
8. Fire hydrant Meters Policy
Fire hydrant meter use is permitted between April 15 and October 15, provided freezing temperatures are not occurring. The customer is responsible for any damage to fire hydrants or fire hydrant meters, which includes vandalism and freezing. A deposit of $2,000 is required, which is fully refundable, provided that the meter is returned in good condition and there is no damage to the fire hydrant. A $165 installation and removal charge, payable in advance, is required (non-refundable). The rental rate shall be $150 per week, plus the water usage rate of $5.50 per 1,000 gallons up to 158,000 gallons, $8.25 per 1,000 gallons from 159,000 gallons up to 632,000 gallons, and $12.37 per 1,000 gallons for 633,000 gallons and over of water per month.
Fire hydrant water shall not be used for drinking purposes at any time. A relocate fee of $85 to move the fire hydrant meter from one fire hydrant to another is required.
Only District personnel are permitted to move fire hydrant meters. Contractors will be subject to a penalty if they attempt to move or alter a fire hydrant meter.
Short term use of fire hydrant meters is allowed without a deposit. The cost to the customer is $85 per hour plus $5.50 per 1,000 gallons up to 158,000 gallons, $8.25 per 1,000 gallons from 159,000 gallons up to 632,000 gallons, and $12.37 per 1,000 gallons for 633,000 gallons and over of water per month.
Payment of the tap fee and installation of the permanent meter in a meter pit for construction water during home construction is strongly encouraged.

The Traer Creek Metropolitan District Residential Incremental Sewer Tap Fee is $0.72 per square foot of living space area. This fee represents 25 percent of Eagle River Water & Sanitation District’s residential sewer tap fee. Floor area is calculated on the gross square foot measurement to include the outside walls, unfinished areas, mechanical rooms, and basements over five (5) feet high, excluding garages, attics and, in a multi-unit or mixed use facility, circulation space. Customer shall provide a letter from the Architect or the Engineer certifying the size of the building using the District’s definition.
8. Expansion or Remodel of Existing Residential Units
Any additions to an existing residential unit will be assessed a tap fee for the additional square footage over 3,000 square feet based on the tap fee calculations shown above.
9. Commercial Incremental Sewer Tap Fee Calculation
This fee represents 25 percent of Eagle River Water & Sanitation District’s commercial sewer tap fee. Commercial use may be on a separate master meter or, for mixed uses, may be on the same meter as Residential/Hotel units, if the customer provides the District with an Engineer’s or Architect’s assessment of the meter size necessary to serve the commercial and irrigation fixtures involved. The District will consider this assessment in the District’s determination of appropriate meter size. The meter size is to be determined by the fixture count assessment according to the International Plumbing Code.
All commercial and/or industrial wastewater users will be required to pre-treat their effluent if their discharge does not meet domestic standards and/or falls under the Federal Classification of Hazardous Waste.
