Water Rights Dedication
Developers of properties to receive water service from the Eagle River Water & Sanitation District (District) or the Upper Eagle Regional Water Authority (Authority) must dedicate water rights, sufficient to serve the development’s water demands and uses. Where adequate water rights are not available to the developer to dedicate, the District or Authority Board of Directors may accept, at its discretion, a cash payment in lieu of water rights dedication. Properties applying for water rights dedication or cash in lieu payment must be included in the District or Authority boundary. Ability to Serve letters and infrastructure approval will not be granted until water rights applications are approved.
If water rights dedication is required, applicants will be required to pay an up-front review fee of $2,000 and submit a completed water demand worksheet. Additional fees may be required for complex applications. Unused fees will be returned to the applicant.
